Agreement to Terms

By accessing or using Kloak ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Eligibility

You must be at least 17 years old to use Kloak. By using the Service, you represent and warrant that you are at least 17 years of age. If you are under 17, you may not use the Service.

Your Account

When you create an account, you must provide accurate information. You are responsible for:

• Maintaining the security of your account and password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to terminate accounts that violate these terms.

Acceptable Use

You agree not to use Kloak to:

• Post illegal content or content that violates any law
• Share child sexual abuse material (CSAM) or any content exploiting minors
• Harass, bully, threaten, or intimidate other users
• Post hate speech targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Share non-consensual intimate imagery
• Impersonate others or misrepresent your affiliation
• Spam, scam, or engage in fraudulent activity
• Post content that promotes violence or self-harm
• Distribute malware or engage in hacking activities
• Attempt to circumvent our moderation systems
• Collect user information without consent
• Use the Service for any commercial purpose without authorization

Content Guidelines

All content posted to Kloak must comply with our Community Guidelines. Content that violates these guidelines will be removed, and repeated violations may result in account suspension or termination.

We reserve the right to remove any content at our discretion, including content that:

• Violates these Terms or our Community Guidelines
• Is flagged by our automated moderation systems
• Is reported by users and determined to violate policies
• We believe poses a risk to users or the community

Your Content

You retain ownership of content you post to Kloak. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

You represent that you have the right to post any content you share, and that your content does not infringe on the rights of others.

Moderation and Enforcement

We use automated systems and human review to moderate content. Our enforcement actions may include:

• Content removal: Removing posts that violate our policies
• Warnings: Notifying users of policy violations
• Temporary suspension: Temporarily restricting account access
• Permanent ban: Terminating accounts for serious or repeated violations
• Legal reporting: Reporting illegal content to appropriate authorities

Legal Compliance

We comply with applicable laws, including:

• Reporting CSAM to the National Center for Missing & Exploited Children (NCMEC)
• Responding to valid legal process and law enforcement requests
• Complying with court orders and subpoenas

Anonymity on Kloak does not exempt you from legal responsibility for your actions.

Intellectual Property

The Kloak name, logo, and all related branding are our intellectual property. You may not use our branding without permission.

Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Kloak shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

Indemnification

You agree to indemnify and hold harmless Kloak from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the app or website. Continued use after changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your account at any time for violations of these Terms. You may delete your account at any time through the app settings.

Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
